TERMS AND CONDITIONS OF SERVICE - AI.RTON

1. Acceptance of Terms

By contracting AI.rton's services, you accept these Terms and Conditions.

2. Services Provided
  • AI.rton provides the following services:

    • Creation of professional websites

    • Development of chatbots

    • Consulting in automation and digital marketing

    • The detailed scope is defined in a specific commercial proposal for each project.

3. Customer Obligations
  • The Client undertakes to:

    • Provide necessary information and content in a timely manner

    • Give constructive and timely feedback

    • Make payments as agreed

    • Respect approval deadlines (3 business days, unless otherwise agreed)

4. Obligations of AI.rton
  • AI.rton undertakes to:

    • Execute the project in accordance with the accepted proposal

    • Meet agreed deadlines (except for delays caused by the Client)

    • Provide training included in the package

    • Provide support in accordance with the contracted package

5. Deadlines
  • Indicative deadlines:

    • Professional Pack: 7-15 business days

    • V.I.P. Pack: 15-20 business days

  • Deadlines may be extended if:

    • The client delays feedback or content delivery

    • There are significant changes to the original scope

    • Unforeseen circumstances arise (force majeure)

6. Payments
  • 6.1 Payment Terms

    • Standard Option (50/50):

      • 50% at the beginning (upon signing the contract),

      • 50% upon delivery (before launch)

    • Other options as per commercial proposal.

  • 6.2 Payment Methods

    • Bank transfer

    • PayPal

    • PayPal

  • 6.3 Late Payments

    • Work may be suspended after 3 days of delay

    • Interest on arrears: 4% per annum (legal rate)

    • After 30 days, the project may be canceled

7. Revisions and Changes
  • Revisions included:

    • Professional Package: 3 revisions

    • Premium Package: 5 revisions

  • Revision = Adjustments to work already delivered (no scope changes)

  • Scope changes:

    • Significant changes to the original project

    • Subject to additional budget

    • Deadlines may be extended

8. Warranty and Support
  • 8.1 15-Day Warranty

    • After launch, we guarantee:

      • Correction of bugs and technical errors

      • Adjustments to function as specified

      • Support for technical issues

    • Does not cover:

      • Design or content changes (these are revisions)

      • Problems caused by changes made by the Client

      • Third-party issues (hosting, domain)

  • 8.2 Ongoing Support

    • According to the package contracted:

      • Professional Pack: 1 month of support

      • Premium Pack: 3 months of priority support

    • After the free period, support is available through:

      • Monthly maintenance plan

      • One-time support ($75/hour)

9. Ownership and Licenses
  • 9.1 Customer Ownership

    • Upon full payment, the Customer owns:

      • Website/chatbot design

      • Content created by AI.rton

      • Developed source code

  • 9.2 Third-Party Licenses

    • Some tools use third-party licenses:

      • WordPress (GPL)

      • Plugins and themes (according to each license)

      • Stock images (royalty-free license)

    • The customer is responsible for renewing licenses after delivery.

  • 9.3 Portfolio

    • AI.rton pode usar o projeto em:

      • Website portfolio

      • Case studies (anonymized if requested)

      • Marketing material

        • The customer may request removal at any time.

10. Limitation of Liability
  • AI.rton is not liable for:

    • Data loss caused by third parties (hosting)

    • Compatibility issues with third-party software

    • Indirect damages or lost profits

    • Content provided by the Customer (copyright, legality)

  • Maximum liability: Amount paid by the Customer for the project in question.

11. Cancellation
  • 11.1 Cancellation by the Customer

    • The Customer may cancel before work begins:

      • Full refund if before we start

      • Partial refund if already started (proportional to the work done)

      • No refund if project >75% complete

  • 11.2 Cancellation by AI.rton

    • AI.rton may cancel if:

      • The Customer violates these Terms

      • The Customer does not provide necessary information (after 15 days)

      • The Customer delays payments (after 15 days)

12. Force Majeure
  • Neither party is responsible for delays caused by:

    • Natural disasters

    • Pandemics

    • Wars or conflicts

    • Infrastructure failures (internet, electricity)

    • Other events beyond reasonable control

13. Applicable Law, Jurisdiction, and Contact Information
  • These Terms are governed by the laws of Portugal.

  • Competent jurisdiction: Lisbon, Portugal.
